All of us have had, or will have, disputes on our projects. There are
three ways of dealing with these problems.
Litigation - Get your lawyer and go to court. When there is big money
involved and everyone hates everybody else, this is the only way. Real
expensive and real slow, but also real effective.
Arbitration - An arbitrator(s) and the parties meet for a formal decision.
Formal and less expensive than litigation it still uses points of law
with a binding decision. Moderately expensive and much faster than litigation;
it is very effective.
Mediation - Both parties are assisted in reaching a decision by the
mediator. Works only when both parties truly want to settle their differences.
This is the common sense approach to problem solving. Not very expensive,
very fast and very effective if the parties REALLY want to resolve their
problem and get on with life.
